Joseph Shekarchi violated a \u201crevolving door\u201d provision of the ethics code by applying for a Rhode Island Supreme Court vacancy.<\/span><\/p>\n<p>Read more <a href=\"https:\/\/bostonrelocationinsider.com\/?p=5382\">A wave of student loan borrowers have entered default since pandemic-era protections lapsed<\/a><\/p>\n<p><span>The nearly two-hour hearing delved into the legal meaning of words such as \u201cor\u201d and \u201cseeking,\u201d but no final decision was reached.<\/span><\/p>\n<p><span>Superior Court Judge Richard A. Yelnosky, former dean of the Roger Williams University School of Law, filed a complaint with the Ethics Commission, arguing that Shekarchi had violated a \u201crevolving door\u201d provision of the ethics code that \u201cprohibits a state elected official, while holding state office and for a period of one year after leaving office, from seeking or accepting employment with any other state agency.\u201d<\/span><\/p>\n<p><span>Shekarchi\u2019s lawyer brought the matter to court on June 25, asking a judge to declare that Shekarchi has not violated the ethics code and order the Ethics Commission to dismiss the complaint.<\/span><\/p>\n<p><span>Licht \u2014 a former lieutenant governor, state senator, and administration director who faced \u201crevolving door\u201d questions when he applied for a judgeship 13 years ago \u2014 peppered Ethics Commission chief prosecutor Jason M. Gramitt with questions about the complaint.<\/span><\/p>\n<p><span>For example, Licht noted that another state legislator, then-Senate Judiciary Committee chairwoman Erin Lynch Prata \u2014 applied for a Supreme Court seat in 2020.<\/span><\/p>\n<p><span>Gramitt explained that Ethics Commission staff concluded a revolving door provision prohibited Lynch Prata from seeking a Supreme Court seat for a full year after leaving office. But commission members voted 5-2 to reject the staff\u2019s advice, opening the door for then-governor Gina M. Raimondo to appoint her to the Supreme Court.<\/span><\/p>\n<p><span>Licht said Lynch Prata has since served on the Supreme Court \u201cwith distinction,\u201d and he questioned why the Ethics Commission did not issue a complaint if it thought she had violated the ethics code. He also noted that no one sought a writ to try to remove her from office, and that the rest of the Supreme Court did not publicly question her appointment.<\/span><\/p>\n<p><span>\u201cEven though it\u2019s not precedent,\u201d Licht said of Lynch Prata\u2019s appointment, \u201cdoes it have any bearing whatsoever on this matter?\u201d<\/span><\/p>\n<p><span>Gramitt said, \u201cI want to suggest that it doesn\u2019t.\u201d<\/span><\/p>\n<p><span>The facts of Shekarchi\u2019s case are different, he said, noting that Lynch Prata sought an advisory opinion from the Ethics Commission while Shekarchi did not.<\/span><\/p>\n<p><span>Also, \u201cTo say that that one case of non-prosecution means that the door is wide open for everyone else after that \u2014 that\u2019s not how that\u2019s not how the law works.&#8221;<\/span><\/p>\n<p><span>Shekarchi\u2019s lawyer, Thomas M. Dickinson, contended that Lynch Prata\u2019s appointment is \u201crelevant historical precedent,\u201d and that the \u201csilence\u201d following her appointment is significant.<\/span><\/p>\n<p><span>He said that since 2020, no bills have been introduced in the General Assembly to try to change or clarify the law about whether legislators must wait a year before trying to join the Supreme Court.<\/span><\/p>\n<p>Read more <a href=\"https:\/\/bostonrelocationinsider.com\/?p=5381\">Trump imposes 50 percent tariff on Canadian goods, citing disputes over autos, alcohol, and cheese<\/a><\/p>\n<p><span>Supreme Court case law holds that \u201cyou can infer legislative assent from silence in certain circumstances,\u201d Dickinson said. \u201cHere, we could infer the Ethics Commission assenting to the way the statute was applied because they never took any steps to seek a modification.\u201d<\/span><\/p>\n<p><span>Also, Dickinson noted that the House and Senate voted to confirm Lynch Prata. \u201cWe certainly can\u2019t infer that they think it\u2019s unconstitutional,\u201d he said.<\/span><\/p>\n<p><span>Gramitt said courts sometimes interpret laws in a way that legislators might assent to or try to change. But he said there was nothing to interpret in Lynch Prata\u2019s case because the Ethics Commission never issued an opinion for her \u2014 it simply voted against adopting the opinion drafted by staff.<\/span><\/p>\n<p><span>Dickinson argued that Supreme Court justice is a constitutional office and therefore specifically exempted by law from the the \u201crevolving door\u201d provision. He also argued that the selection of Supreme Court justice is spelled out in the state Constitution, and that the ethics code can\u2019t trump a \u201cconstitutionally authorized procedure\u201d for filling a vacancy.<\/span><\/p>\n<p><span>The legal arguments focused on an exception to the \u201crevolving door\u201d provision that says, \u201cNothing contained herein shall prohibit a state elected official from seekingor being elected for any other constitutional office.\u201d<\/span><\/p>\n<p><span>Gramitt argued that the exception applies to those who seek elected constitutional offices, such as governor or attorney general \u2014 not appointments to the judiciary.<\/span><\/p>\n<p><span>Dickinson accused Gramitt of ignoring the statute\u2019s use of the word \u201cor.\u201d<\/span><\/p>\n<p><span>Shekarchi is \u201cseeking\u201d the constitutional office of Supreme Court justice, he said. \u201cThe revolving door exception plainly applies to him, and the prosecution\u2019s magical and wishful attempt to replace the word \u2018or\u2019 with the entirely different word \u2018and\u2019 must be rejected,\u201d he wrote in a legal brief.<\/span><\/p>\n<p><span>But Gramitt told the judge there is no disagreement about the proper meaning of \u201cor.\u201d<\/span><\/p>\n<p><span>\u201cRather,\u201d Gramitt said in a legal brief, \u201cthe dispute between the parties concerns whether the word \u2018seeking\u2019 in the phrase \u2018seeking or being elected for\u2019 means seeking appointment,\u201d as Shekarchi contends, or \u201cseeking election,\u201d as the Ethic Commission contends.<\/span><\/p>\n<p><span>Gramitt said the Supreme Court made clear in a 1993 advisory opinion that the exception was intended to apply only to those seeking elected positions, not appointed positions.<\/span><\/p>\n<p><span>Gramitt asked the judge to dismiss Shekarchi\u2019s complaint and send the case back to the Ethics Commission for further proceedings.<\/span><\/p>\n<p><span>In brief remarks after the hearing, Shekarchi said he is confident in his legal case.<\/span><\/p>\n<p><span>Yelnosky, who filed the complaint against Shekarchi, reacted to the day\u2019s arguments on social media.<\/span><\/p>\n<p><span>\u201cNotoriously difficult to predict outcomes based on argument,\u201d Yelnosky wrote on X. \u201cBUT I expect Judge Licht will rule for Shekarchi. The (Judicial Nominating Commission) will meet on July 28. If he does not make their list, the case could be moot.
