But Kirk\u2019s family walked out of the courtroom after the prosecution\u2019s first witness \u2014 a police officer \u2014 started testifying about Kirk\u2019s arrival on campus the day he was shot.<\/span><\/p>\n<p><span>The five-day preliminary hearing will mark the most significant presentation of evidence in the case against defendant Tyler Robinson.<\/span><\/p>\n<\/div>\n<div>\n<p><span>Robinson\u2019s parents also were present, a few rows behind where the Kirks sat as the hearing began. The 23-year-old defendant is charged with aggravated murder in the Sept. 10 assassination of Kirk, a conservative activist and ally of President Donald Trump, at Utah Valley University. He wore a gray suit, and his wrists were shackled to a chain around his waist.<\/span><\/p>\n<p><span>Prosecutors allege he confessed in a note left for his roommate, who was also his romantic partner, that read: \u201cI had the opportunity to take out Charlie Kirk and I\u2019m going to take it.\u201d<\/span><\/p>\n<p><span>Robinson has not yet entered a plea, and his attorneys have not commented on his guilt or innocence. They have, however, sought to get the death penalty taken off the table, so far unsuccessfully.<\/span><\/p>\n<p><span>The proceeding resembles a mini-trial, but prosecutors need only demonstrate that there are reasonable grounds to believe Robinson killed Kirk. The standard is lower than for a trial, where prosecutors must prove guilt \u201cbeyond a reasonable doubt.\u201d<\/span><\/p>\n<p><span>Prosecutors expect to present between 40 and 50 exhibits during this week\u2019s hearing.<\/span><\/p>\n<p><span>Chief Deputy Utah County Attorney Chad Grunander told state District Judge Tony Graf that the exhibits will include several videos of the Sept. 10 shooting, which occurred as Kirk was addressing a crowd of thousands at Utah Valley University.<\/span><\/p>\n<p><span>The videos will be shown on a courtroom monitor that is being set up so that it won\u2019t be captured by the press videographer in the courtroom, said Graf.<\/span><\/p>\n<p><span>The prosecution\u2019s first witness, former Utah Valley University police officer Chris Bagley, said he could see the right side of Charlie Kirk\u2019s body as Kirk spoke on campus. Kirk was answering a question when Bagley heard a gunshot, he said, and chaos erupted and people started to run.<\/span><\/p>\n<p>Read more <a href=\"https:\/\/bostonrelocationinsider.com\/?p=4415\">\u2018The Five Star Weekend\u2019 is a love letter to female friendship with a starry cast<\/a><\/p>\n<p><span>Once the hearing is finished, Graf must determine whether there is enough evidence for the case to proceed to trial.<\/span><\/p>\n<p><span>Prosecutors have said they plan to present DNA evidence linking Robinson to the suspected murder weapon, testimony from investigators, autopsy findings, witness statements and video of Kirk\u2019s killing. They are also expected to argue the shooting endangered others at Kirk\u2019s campus event \u2014 an aggravating circumstance that could make the crime punishable by death under Utah law.<\/span><\/p>\n<p><span>Prosecutors this week can use secondhand information, or hearsay, to help present their case.<\/span><\/p>\n<p><span>Robinson\u2019s roommate is not expected to testify in person during the hearing. Still, the roommate\u2019s recorded testimony could be a focal point for prosecutors.<\/span><\/p>\n<p><span>In addition to the alleged confession note, Robinson reportedly texted his roommate that he targeted Kirk because he \u201chad enough of his hatred,\u201d prosecutors have said.<\/span><\/p>\n<p><span>Before his death, Kirk and the organization he co-founded, Turning Point USA, galvanized the conservative youth vote to help Trump win a second term.<\/span><\/p>\n<p><span>The Republican president has said he hopes Robinson receives the death penalty.<\/span><\/p>\n<p><span>Erika Kirk said during his memorial service that she forgives Robinson.<\/span><\/p>\n<p><span>Ahead of Monday\u2019s hearing, she thanked supporters in a statement posted to X for their kindness and prayers.<\/span><\/p>\n<p><span>\u201cEvery court proceeding serves as a painful reminder of his death,\u201d she wrote, \u201cand the loss that has irrevocably impacted our lives and the lives of his children.\u201d<\/span><\/p>\n<p><span>She added that the public outpouring \u201chas sustained us during the darkest days of our lives.\u201d<\/span><\/p>\n<p><span>She is expected in court throughout the week with her husband\u2019s parents, Robert and Kathryn Kirk, according to a person familiar with the situation who spoke on condition of anonymity because they were not authorized to speak publicly.<\/span><\/p>\n<p>Read more <a href=\"https:\/\/bostonrelocationinsider.com\/?p=4413\">Trump + FIFA = Corruption squared<\/a><\/p>\n<\/p>\n<\/div>\n<\/article>\n","protected":false},"excerpt":{"rendered":"<p>Tyler Robinson has not yet entered a plea, and his attorneys have not commented on his guilt or innocence. <\/p>\n","protected":false},"author":1,"featured_media":4418,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[],"class_list":["post-4419","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-politics"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
